Terms of Service
The terms on which this website is made available. They govern the website itself — consulting work is governed by a separate written agreement.
Last updated: 23 October 2026
1. Agreement to these terms
By accessing or using kapiconsulting.ca (the "website"), you agree to these Terms of Service. If you do not agree with them, please do not use the website. In these terms, "Kapi Consulting", "we" and "us" mean Kapi Consulting, a consulting practice based in Vancouver, British Columbia, Canada.
2. What this website is
The website describes Kapi Consulting's services and background and provides a way to get in touch. It is an information and marketing resource. It is not an offer to enter into a contract, and nothing on it creates an obligation on us to provide services to you.
3. No professional advice and no consulting relationship
The content on this website is general information only. It is not operational, engineering, financial, legal or other professional advice, and it does not take account of the circumstances of any particular business. You should not act, or refrain from acting, on the basis of anything on this website without obtaining advice specific to your situation.
Using the website, sending an enquiry or having an initial conversation does not create a consultant–client relationship. That relationship begins only when we and you sign a written engagement agreement setting out the scope, deliverables, fees and terms of the work. Where that agreement conflicts with these terms, the engagement agreement governs the work.
4. Case studies and results
The website describes outcomes achieved on past engagements, including figures such as improvements in product quality, equipment effectiveness and lead time. Those figures reflect specific projects in specific operating environments, and are presented as examples of work performed.
Past results are not a prediction or guarantee of future results. Outcomes depend on factors particular to each organisation, including the condition of its processes, the quality of its data, the resources it commits and the engagement of its people. Nothing on this website should be read as a promise of any particular result, saving or return.
Client names are withheld and project details are generalised to protect client confidentiality. Reference to an industry or sector does not imply any endorsement by, or ongoing relationship with, any organisation in it.
5. Intellectual property
The website and its contents — including text, page design, layout, graphics, photographs, diagrams, frameworks and the Kapi Consulting name and logo — are owned by Kapi Consulting or used under licence, and are protected by Canadian and international intellectual property law.
You may view the website, and print or download extracts for your own internal, non-commercial reference. You may not otherwise reproduce, republish, redistribute, modify, frame, sell or exploit any part of it, or use it to train machine learning models, without our prior written permission. All rights not expressly granted are reserved.
6. Acceptable use
You agree not to:
- use the website for any unlawful purpose, or in breach of these terms;
- attempt to gain unauthorised access to the website, its server or any connected system;
- introduce malware, or otherwise interfere with the proper working of the website;
- use automated means to scrape, harvest or place unreasonable load on the website;
- collect email addresses or other contact details from the website for unsolicited communications.
7. Third-party links
The website links to external sites, such as LinkedIn, which we do not control. Those links are provided for convenience and are not an endorsement of the site or its content. We accept no responsibility for external sites, and your use of them is at your own risk and subject to their terms.
8. Availability
We aim to keep the website available, but we do not guarantee that it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it, or the whole of it, at any time and without notice.
9. Disclaimer of warranties
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all representations, warranties and conditions of any kind, whether express, implied or statutory, including as to accuracy, completeness, currency, merchantability, fitness for a particular purpose and non-infringement. While we take reasonable care, we do not warrant that the content is accurate or complete or that it remains current.
10. Limitation of liability
To the fullest extent permitted by law, Kapi Consulting and Dr. Neehal Mooruth will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, business, data, goodwill or anticipated savings, arising out of or in connection with your use of — or inability to use — this website, however caused and on any theory of liability.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.
11. Indemnity
You agree to indemnify Kapi Consulting against any claim, loss, liability or reasonable expense arising from your breach of these terms or your unlawful use of the website.
12. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these terms.
13. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of British Columbia, subject to any mandatory consumer protections available to you where you live.
14. Changes to these terms
We may revise these terms at any time. The revised version takes effect when posted here, and the date at the top of this page will change. Continuing to use the website after a change means you accept the revised terms.
15. General
If any provision of these terms is found unenforceable, the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us in respect of the website.
16. Contact
